Me Gilles Guilad Krief, LL.B., J.D.

Me Gilles Guilad Krief is a lawyer and member of the Quebec Bar since 2010. In 2023, he founded Judilex Avocats in order to diverse his legal services and henceforth serve clients by prioritizing the means of improving their access to justice.

Me Krief specializes in civil, commercial and administrative litigation, in the field of real estate. He focused particularly in the field of real estate of communities, such as condominium law, housing cooperative and not-for-profit housing law.

He also serves employers and employees in the field of labor law, for small and medium companies, non-profit organizations, solidarity and producers cooperatives and work and shareholding workers cooperatives.

Mr. Krief has successfully represented litigants in numerous cases, some of which have been cited in case law and have been the subject of commentary in legal literature. He also gave interviews and communications in the media, covering subjects such as class actions and consumer law.

He has pleaded before all judicial courts of Quebec and has been involved in several important class action lawsuits in the areas of consumer rights, banks and insurance companies, financial services, environmental pollution and product liability.

  • > Lawsuit against the Attorney General of Quebec: obtained a judgment splitting the proceedings in two, avoiding the plaintiff having to commit significant funds in expertise.

    > Prosecution of a predominant artist on the Quebec music scene against his producer: obtained a judgment confirming the jurisdiction of the Superior Court.

    > Defense of a private school in the context of a lawsuit brought by the owner of its buildings: notably obtained the rejection of the request for eviction from the premises.

    > Defense of a former partner against a request for a provisional injunction from a sports company: obtained the dismissal of this procedure.

    > Defense of a lawyer at the Human Rights Tribunal against allegations of discrimination under the Charter of Human Rights and Freedoms (case settled, with anonymity obtained from the tribunal).

    > Lawsuit and termination of the franchise contract of a restaurant in the largest food franchise network in Quebec: obtained the revocation of a default judgment and contributed to the settlement of the case.

    > Application in evocation to the Superior Court brought on behalf of the members of a religious non-profit organization.

    > Lawsuit against the City of Montreal for a series of recurring floods of a building held in co-ownership.

    > Lawsuit against a sports center because of noise pollution from its ventilation system, for the benefit of a syndicate of co-ownership of a luxury real estate complex in Montreal.

    > Various lawsuits for termination of commercial leases and eviction and numerous mortgage remedies (mortgage remedies in construction, on behalf of syndicates of co-ownership, and cancellation or reduction of mortgages).

    > Representation and advice to several cooperatives following applications for judicial review filed in the Superior Court by their members.

    > Defending a residential landlord against a claim by its tenants for nearly $180,000 in Superior Court.

    > More than 150 residential rental cases, settled out of court or awarded by the Administrative Housing Tribunal.

  • > Involved in a major class action against a dozen banks, in connection with various practices concerning credit card fees, according to the requirements of the Consumer Protection Act; successive settlements of nearly $54 million (2010-2015).

    > Involved in a financial fraud class action involving the liability of various financial institutions (federal trust, brokerage firms, an insurance company and an accounting firm); Several judgments obtained in connection with the authorization of the class action, the merits of the case and the approval of multiple agreements (2010-2016), for an amount of more than $4 million.

    > Judgment obtained in 2019 at the Superior Court, condemning the brokers and an insurance company to an amount of more than seventeen million dollars, confirmed in 2021 by the Quebec Court of Appeal as to the insurance company for an amount determined according to the applicable insurance coverage limit (not involved in the appeal proceedings).

    > Involved in the authorization and procedures of the class action filed by a citizens' committee of the Municipality of the Village of Val-David against the owner of a sand pit and a trucking company; judgment on the merits rendered by the Superior Court in 2019 (not involved during the trial).

    > Involved in the preparation and settlement discussions prior to authorization of the class action filed by a committee of neighbours of the Glen Site Hospital (MUHC), in connection with noise nuisance in the neighbourhood.

    > Involved in the authorization, procedures and settlement of the class action undertaken by the Comité Environnement Ville-Émard against owner-shareholders of a plant who have been sentenced for several years instead to pay them amounts related to the pollution of the neighborhood and their neighborhood.

    > Studied and accompanied for nearly two years a committee of neighbors bordering the A20 highway in their enquiries in connection with noise pollution from this highway.
